Welcome to iChef we as a food delivery application connecting customers and chefs. These Terms and Conditions ("Terms") govern your use of our mobile application and website (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Overview
iChef enables Customers to order food, hire chefs for events, and manage profiles, and Chefs to provide food or services, manage orders, and interact with customers. These Terms apply to both user types unless specified.
2. User Accounts
- Eligibility: You must be at least 10 years old (user) and 18 years old (chef) to use the Service. By creating an account, you confirm you meet this requirement.
- Customer Accounts:
- You may onboard yourself, verify your identity (e.g., email, phone), and set your location.
- You are responsible for maintaining accurate profile information, including addresses and payment details.
- You may edit your profile, manage addresses, view order/booking history, change passwords, or delete your account via the app settings.
- Chef Accounts:
- You must complete verification (e.g., email, phone, identity documents, certifications) to offer services.
- You are responsible for providing accurate service details and maintaining valid documentation.
- You may manage your profile, addresses, and account settings (e.g., change password, delete account) via the dashboard.
- Account Security: You are responsible for keeping your login credentials confidential and reporting unauthorized access to Support@iceinnovations.com.
3. Orders and Bookings
- Customers:
- You may order food on-demand, hire chefs for events, view chef profiles, add items to your cart, and track or cancel orders.
- You agree to provide accurate order details (e.g., delivery address, preferences).
- Payments are processed via third-party providers Stripe. You are responsible for ensuring sufficient funds.
- You may review or rate chefs/orders, but reviews must be truthful and comply with our guidelines (no defamatory or abusive content).
- Chefs:
- You may accept, process, or deliver orders via the dashboard, which displays pending, processing, or delivered orders.
- You agree to fulfill orders as described and communicate with customers via in-app chat.
- You are responsible for complying with food safety and local regulations.
- Cancellations:
- Customers may cancel orders subject to our cancellation policy (available in the app).
- Chefs may decline orders but must notify customers promptly.
- We reserve the right to charge fees for late cancellations, as specified in the app.
4. User Conduct
- Permitted Use:
- Use the Service only for lawful purposes (e.g., ordering food, providing services).
- Customers and chefs may communicate via in-app chat but must not share personal contact information outside the platform.
- Prohibited Actions:
- Submitting false information during onboarding or verification.
- Using the Service to harass, defame, or harm others.
- Attempting to hack, disrupt, or misuse the Service.
- Violating intellectual property, privacy, or other laws.
- We may suspend or terminate accounts for violations, at our discretion.
5. Payments and Fees
- Customers: You agree to pay for orders and bookings as displayed in the app. Prices include applicable taxes and fees.
- Chefs: You receive payments for services minus our service fees, as outlined in the app. Payments are processed via third-party providers.
- Refunds: Refund requests are handled per our refund policy (available in the app). Contact Support@iceinnovations.com for disputes.
6. Intellectual Property
- The Service, including its design, logos, and content, is owned by iChef or our licensors and protected by copyright and trademark laws.
- You may not copy, modify, or distribute any part of the Service without our written permission.
7. Privacy
- Our Privacy Policy available at ichef.co/privacy-policy governs how we collect, use, and protect your data. By using the Service, you agree to the Privacy Policy.
8. Limitation of Liability
- The Service is provided “as is” without warranties of any kind, express or implied.
- We are not liable for:
- Errors, delays, or interruptions in the Service.
- Losses due to inaccurate order details, chef performance, or customer actions.
- Indirect, incidental, or consequential damages arising from the Service.
- Our total liability is limited to the amount you paid for the Service in the past 12 months.
9. Termination
- Customers: You may delete your account via the app settings. We may terminate your account for violations of these Terms.
- Chefs: You may delete your account via the dashboard. We may suspend or terminate your account for failure to meet verification standards or other violations.
- Upon termination, you lose access to the Service, but certain provisions (e.g., liability, intellectual property) survive.
10. Dispute Resolution
- Any disputes arising from these Terms will be governed by the laws of USA.
